The Darwin ClauseI had a rather good idea come to me, though of course I know it will never happen, espcially in the U.S. with all the damned annoying bleeding hearts, but really I think it would make things all so much easier, and better in the long run, and it would save money.
I have decided there should be what I like to call the Darwin Clause, in the court system. In which, if a person does something blatantly stupid and that anyone with even a shred of common sense would just say well duh, and they get themselves hurt doing it and than try to sue someone else for it, the judge just be able to just say. "After reviewing your case, I have decided that you are too stupid to deserve any money, case closed." I am also really sort of liking the fact of bringing back public flogging so to try and discourage people in the future from trying to get money from someone else because they are morons, if the judge turns down their case in the Darwin Clause, they should than be flogged at least 10 times, in public, for trying to waste people's time and money instead of taking responsibility for their own stupidity. And I think included in this clause should also be, if a person is drunk, and hurts themselves in a public facility in a way that is directly related to them being drunk, and would not have happened if they were sober, and than they try to sue for it. You know how many frivolous lawsuits this would get rid of? Also it would curb the behavior, once people begin to realize, they cannot just get rich or at least a healthy sum of money just by trying to cry wolf. And maybe, under the Darwin Clause if one tries to someone one, and the one being sued obviously and clearly, were not in any way responsible for the accident than the person suing them should have to pay a fine to the ones they tried to sue. Of course the rules of the Darwin Clause would only apply in cases of extreme blatant stupidity or also, if one gets hurt because they ignore safety rules and than try and sue. For example if one was at an amusement park, and on a roller, where there are signs everywhere that say, to stay seated at all times, but during the ride, they decide to stand up and than get decapitated by some piece of equipment. If their family tries to than sue it should come under the Darwin Clause. 8:35 AM - 6/3/2008 - post comment
