The Department of Trade and Industry (DTI) has filed administrative charges against ABS-CBN Network after it found irregularities in the defunct "Wilyonaryo" segment of the noontime show Wowowee.
It was on August 20, 2007 when "Wilyonaryo" became controversial because of the two numbers, "0"and "2," that contained the violet "jackpot" wheel of the said segment.
On September 13, 2007, the DTI organized a fact-finding team that would investigate on the incident. The team was composed of the Consumer Welfare Trade Group, Bureau of Trade Regulation Protection of DTI, representatives from Movie and Television Review and Classification Board (MTRCB), Kapisanan ng mga Brodkaster ng Pilipinas (KBP), and a consumer organization.
The panel probed on the controversy for two months and released its recommendations last November 9.
Last night, January 15, Saksi reported that DTI-National Capital Region Area 3, which has jurisdiction over ABS-CBN in Quezon City, has filed a case at the Office of the Regional Caretaker of DTI-NCR based on investigation conducted by the fact-finding panel.
DTI-NCR, which serves as the court in the said case, gave ABS-CBN Network 10 days to answer the charges.
Assistant Secretary Angel Pelayo, DTI-NCR director, said their agency would wait for ABS-CBN's reply to the charges. She reiterated, "Noong January 11, nagsampa ng formal charge ang Area 3 director ng DTI-NCR sa opisina ko, and the formal charge is versus ABS-CBN Broadcasting Corp. Nag-send na ng summons, and we are waiting for their reply."
DTI, however, refused to disclose the details on the charges and the recommendations of the fact-finding team.
DISAPPOINTED. On the other hand, ABS-CBN Network expressed their disappointment with the DTI's charges through the following official statement they sent out to the media:
"ABS-CBN is extremely disappointed with the charges filed by the Department of Trade and Industry... ABS-CBN categorically denies any wrongdoing or violation of law.
"ABS-CBN reiterates, there was a design flaw in the wheels but there was never any intention to gain any advantage over contestants or control the outcome of the contests.
ABS-CBN will answer the charges and is confident that it will be absolved of any liability."
KBP CLEARS WOWOWEE. Meanwhile, a press release sent to PEP (Philippine Entertainment Portal) by ABS-CBN yesterday, January 15, it stated that KBP has cleared Wowowee over the "Wilyonaryo" scam.
KBPs legal counsel, Atty. Rudolph Jularbal, said that their Standards Authority Committee found that there was no cheating after investigating the equipment used in the game and interviewing the Wowowee's production staff.
Moreover, the KBP also reviewed the tape of the episode and determined that Wowowee host Willie Revillame was genuinely surprised at the mistake.
In the end, ABS-CBN welcomed KBP's decision and stated, through its Corporate Communications Head, Bong Osorio, "We've always told the truth. And the truth will always come out."

At sa muling pagtuntong ni Angelika sa studio kung saan ginanap ang live telecast ng S.O.P. earlier today, January 6, medyo nanibago pa siya to see old faces, and even friends na galing sa Dos na lumipat na rin sa Siete.
"Excited ako, lalo na nang maramdaman kong welcome ako agad," sabi ni Angelika. "Pero, may naramdaman din akong lungkot sa pag-alis ko from ABS-CBN. Kasi, marami na rin akong naging friends doon.
"Yun nga lang, mas masaya itong pagbabalik ko sa GMA-7. I got to be more positive. Two years yung exclusivity ng contract kaya it's really a much better deal," dugtong ng dalaga.
Hindi pa man siya nag-uumpisa for Babangon Ako't Dudurugin Kita, nasabi na sa kanya na mayroon pa siyang isang gagawin na show para sa Kapuso Network.
"Okay na sa akin yung may teleserye muna ako na maganda ang role ko. Hindi ko iniisip kung kontrabida ba ito, pero may pagkabida rin in some aspects yung role ko. At saka very challenging talaga.
"I never burn bridges. Maski nga itong pag-alis ko sa ABS-CBN, I made sure na maayos lahat, nakipag-usap ako nang maayos. Para wala na yung mga nega-negang chika.
"Marunong akong tumanaw ng utang na loob. Ayoko nang manisi pa kung bakit lumipat ako, kasi, decision ko naman ito. Ganoon lang ang sinusunod ko, kung saan ako masaya, roon ako," lahad ni Angelika, na ang huling proyekto sa ABS-CBN ay ang Prinsesa ng Banyera. Pumasok sa naturang teleserye si Ara Mina, na siyang tumigil naman sa pag-tape ng GMA-7 comedy show Bubble Gang.
Sa tingin ba niya, makakasundo niya si Yasmien Kurdi na co-star niya sa Babangon Ako't Dudurugin Kita?
"Okay naman kami, pero hindi pa kami close. Pero, sa nakikita ko sa kanya, palagay ko, magiging good friends din kami. I have that feeling," sambit pa niya.
Once and for all, ano ba talaga ang naging problema ni Angelika sa Dos? "Wala naman talagang problema. It's just that, hindi na talaga ako naging masaya. Pero, ayoko kasing magsalita ng kung anu-ano dahil natulungan din naman nila ako.
"Naiitindihan naman nila roon yung stand ko, at okay na rin sa kanila na subukan ko uli sa GMA-7. Kasi, nakita ko kasing maganda ang offer na mahirap tanggihan.
"Yun lang naman 'yon. At saka ayoko munang magtrabaho nang walang katiyakan," paliwanag ni Angelika.
Mas marami nga raw ang nakaka-appreciate sa bagong Angelika kaysa noong namamayagpag pa ito sa GMA-7 bago siya lumipat sa Dos.
"Ah, yun kasi ang time na bata pa ako. I was really bratty. Inaamin ko naman 'yan. Pero, siyempre, nagma-mature ang tao. At saka kapag happy ka, lalo sa lovelife mo, malaking bagay 'yun.
"But, basically, dala lang yun ng kabataan. Minsan, nagbabaliw-baliwan ka," at natawa na lang siya.
Nasabi nga ni Sunshine Dizon na happy siya sa pagbabalik ni Angelika sa Siete, at okey lang din dito na muli silang magkasama sa isang teleserye.
"Ganoon din ang feeling ko. Hindi na kami nagkaroon ng communication ni Sunshine mula nang lumipat ako sa Dos noon.
"I must admit, dahil mga bata pa kami noon, natangay kami ng mga intriga. Kung anu-anong parating na kuwento kasi, na dapat ay hindi namin inintindi.
"Pero, wala namang samaan ng loob sa amin ni Shine, na puwedeng makaapekto sa pagsasama namin. Pareho na kaming mature. Masaya ako sa idea na puwede kaming magkasama ngayong pareho na kaming Kapuso," pahayag ni Angelika.

After the show folded up, Nadine went on to star in two other soaps"bilang main lead sa Sine Novela na Kung Mahawi Man Ang Ulap opposite her Super Twins "mentor" Dennis Trillo at sa Marimar bilang si Inocencia.
Si Jennylyn naman, nagpahinga ng ilang buwan dahil sa gulo sa pagitan ng kanyang manager na si Becky Aguila with GMA-7 and last part of 2007 na lang siya nakabalik with La Vendetta.
May bagong sisimulan na sanang Sine Novela si Jennylyn na first time pairing pa man din with real-life boyfriend Patrick Garcia, ang Maging Akin Ka LAmang. Naka-two days taping na sila nang biglang sumabog ang balita na buntis si Jennylyn, so kinailangang i-recast ang show. Exit Jennylyn and enter her "super twin" na si Nadine.
Nag-text ang PEP (Philippine Entertainment Portal) last January 4 kay Nadine para tanungin ang reaction niya sa pagkakabuntis ni Jennylyn.
"Siyempre, nakakagulat," sagot ni Nadine sa amin. "Siguro it's a blessing for her na rin so congrats na lang and ingat siya sa sarili niya."
Kahapon, January 5, ang start ng taping ni Nadine for Maging Akin Ka Lamang dahil kahapon niya lang din nalaman na siya ang papalit kay Jennylyn.
Kuwento ni Nadine, "Ngayon ko lang po nalaman kasi na-text po ako ng handler ko at na-forward agad yung taping schedule. Dalian nga po, actually may taping na po ako tomorrow.
"Nung una ko pong narinig ang balita, hindi pa ako naniwala na sa akin ibibigay kasi may Marimar pa ako. Naayos na po pala nila ang schedule ko."
Hindi raw alam ni Nadine kung alam na ni Jennylyn na sa kanya napunta ang role nito, but she will try to text her daw.
With Maging Akin Ka Lamang and Marimar, tiyak na full schedule muli si Nadine kaya naitanong na rin namin sa kanya ang reaction niya na napakarami niyang fans ang nagpe-petition na siya rin ang gumanap na Dyesebel.
"Hahaha! Ang ganda naman pakinggan and how I wish sana po. Kasi noong bata pa ako, gusto ko talagang maging mermaid. Hehehe, I'm praying na sana po talaga," sagot niya sa amin sa text.
We asked her given a choice, ano ang mas pipiliin niya, ang Dyesebel o ang Darna role. Minsan na kasi siyang gumanap na sirena sa Ang Mahiwagang Baul sa "Alamat ng Sirena" at isa naman siya sa guest star noon ng Darna bilang incarnate ni Valentina.
"Even I know it's hard to choose, I'd rather choose Dyesebel po," sagot niya.
Kinamusta din namin ang estado ng relasyon nila ng scion to a big lechon business na si Emerson Chua. Emerson and Nadine have been on for more than two years na.
"We're doing great po, and kami pa rin, hehehe!" aniya.
Tinanong namin kay Nadine kung may wedding plans na sila.
"Wala pa po, matagal pa po yun. Mas maganda ‘pag ang wedding bongga kaya dapat ipon muna."
Hiningan din namin siya ng reaction sa isang comment ng PEPster regarding sa Super Twins na lahat ng main stars nito (Dennis, Jennylyn, Patrick, Camille Prats, and the first villain na si Tanya Garcia) ay naging parent by 2007 at siya na lang ang hindi. Biro namin, baka siya na ang sumunod.

Nakatanggap ang PEP (Philippine Entertainment Portal) ng balita kanina lamang, January 3, mula sa isang staff ng showbiz talk show na kumpirmadong buntis ang young actress na si Jennyly Mercado.
Ayon sa source ng PEP, six weeks and two days na ang dinadala ni Jennylyn courtesy ng kanyang boyfriend na si Patrick Garcia. Nagpa-check-up sina Jennylyn at Patrick sa St. Luke's kanina at dito nga nakumpirma ang pagbubuntis ng young actress na magtu-21 years old pa lang sa May 15.
Nang kumpirmahin ng staff ng showbiz talk show ang balitang buntis si Jennylyn, inamin naman daw ito agad ng young actor. Idinagdag pa ni Patrick na pananagutan niya ang dinadala ni Jennylyn.
Sa katunayan, at press time ay kasalukuyang nasa Makati City Hall sina Jennylyn at Patrick at nagpapakonsulta ang dalawa para sa nalalapit nilang pagpapakasal. Ayaw raw kasi ni Patrick, 26, na lumabas ang bata na hindi pa sila kasal ni Jennylyn.
Magkasama sina Jennylyn at Patrick sa bagong Sine Novela ng GMA-7, ang Maging Akin Ka Lamang. Tiyak na makakaapekto ang pagbubuntis na ito ni Jennylyn sa magiging takbo ng naturang afternoon soap opera.
Ang maganda lang dito sa pagbubuntis ni Jennylyn ay inalok siya ng kasal ng ama ng kanyang magiging anak. |

![]() ![]() Gumawa ng movie ad trailer ang GMA-7 para sa mga bagong primetime shows nito for 2008. Ipalalabas ang nasabing trailer sa lahat ng sinehan starting this Christmas, sa pagbubukas ng 2007 Metro Manila Film Festival. Hindi pa man nagsisimula ang MMFF, ipinakita na ito sa premiere night ng Resiklo noong December 22 sa SM Megamall.
Sandwiched ang apat na shows sa pinaka-teaser ng Valentine movie ng GMA Films at Regal Films na A Very Special Love, ngunit si Richard Gutierrez lang ang ipinakita, with a blurb that says, "She is definitely coming this Valentine."
Ang unang ipinakita ay ang Joaquin Burdado nina Robin Padilla at Iza Calzado. Heavy ang special effects ng trailer dahil nabubuhay ang mga tattoo sa katawan ni Robin as Joaquin Burdado na parang nag-aapoy.
Directed by Mac Alejandre and Argel Joseph, Joaquin Burdado also stars Mark Herras, Iwa Motto, and Cristine Reyes, although may usap-usapan na planong lumipat ng bakuran ang nakababatang kapatid ni Ara Mina.
Ang ikalawa ay ang napaka-glossy na Babangon Ako't Dudurugin Kita, ang kauna-unahang Sine Novela for primetime. Ang dalawang magiging kontrabida sa soap muna ang ipinakita, sina Marvin Agustin at Angelika dela Cruz, bago lumabas as separate shot ang mga bidang sina Yasmien Kurdi at JC de Vera.
Ito ang mag-aakyat sa tambalan nina Yasmien and JC sa primetime after lording over the afternoon slot with two successive, successful Sine Novelas, Pati Ba Pintig Ng Puso at Pasan Ko Ang Daigdig. Ito rin ang pagbabalik ni Joel Lamangan sa primetime ng GMA-7. His last project was in 2002, Kung Mawawala Ka.
The third soap is Mars Ravelo's Dyesebel. Dahil wala pang napipiling artista na gaganap sa soap, nakatalikod lang palagi si Dyesebel.
Ang pang-apat ang ikinagulat ng audience dahil bagama't nasusulat nang magbabalik si Darna, hindi inakala na makakasama niya pala rito si Captain Barbell. The tentative soap title is Captain Barbell Meets Darna.
Si Richard Gutierrez pa rin ang naka-peg na gaganap bilang Captain Barbell, although hindi pa alam kung mauuna ba ito or ang kanyang Gagamboy once his Kamandag finishes by first quarter of 2008.
Wala pa ring napipili ang GMA-7 na gaganap bilang Darna, na unang ginampanan ni Angel Locsin. Sa 7th floor (Entertainment TV) ng GMA Network Center, puwedeng mag-cast ng vote ang mga empleyado kung sino ang gusto nilang maging Darna. |

Hindi makapaniwala si Isabel na sa kanya ibinigay ang role bilang Rosita Monteverde na unang ginampanan ni Lorna sa pelikula. Paborito raw kasi ni Isabel si Lorna at laking tuwa niya nang siya ang mapili sa coveted role na ito.
"Before, I used to play Christopher de Leon's son, now I'm playing one of his memorable roles," nakangiting wika ni Patrick. "It's a big challenge for me because it's a good role and a very good actor portrayed it first. Nakaka-pressure because hindi malayong ma-compare ako talaga. But I will do my best para naman kahit paano ay magampanan ko nang maayos yung role."

Palos, one of the biggest budgeted and most talked
about projects of ABS-CBN, will start showing in summer 2008. The Kapamilya network remakes the movie that made Bernard Bonnin
an action superstar in the ‘70s.
The title Palos is the Tagalog word for "eel""the snakelike fish that's
quick, slick, and hard to capture. These qualities make for Jake's
character: swift, smooth, versatile. Palos is based on the classic Filipino comics
and film character of the same name, a professional thief who is adept in the
fighting arts and possesses acrobatic skills. He's as slippery as an eel and as rarely caught.
The TV series is based on the Palos
movies that were released from the 1960s to the 1980s. The character was
created by Virgilio and Nestor Redondo and first introduced to the public
in the Tagalog Klasiks comic-strip serial "Alyas Palos." Actor Bernard Bonnin
played the character in all eight films, starting with Alyas Palos in
1961. Joining them are some of the biggest stars in the industry"Jomari Yllana, Sunshine Cruz, Jodi Sta. Maria-Lacson, Roxanne Guinoo, Carla Humphries, Julia Barretto, Jay-R Siaboc, Gloria Romero, Wendy Valdez, Vandolph, Dennis Padilla, Red Ford White, Ron Maloles, and Regine Angeles. |

Tampok ang mga pinakabagong Korean heartthrobs na sina Daniel Henney at Sep Do Young, at mga magagandang mga leading ladies na sina Han Hyo Joo at Lee So Yeon.
Iikot ang serye sa madulang buhay nina Jeric (Seo Do Young) at Arianne (Han Hyo Joo), dalawang pusong sa murang edad pa lamang ay sinubok na ang tibay ng pagkakaibigan.
Upang iligtas ang buhay ng kababata, isasakripisyo ni Jeric ang kanyang buong pagkatao at magpapanggap bilang si Christian, ang yumaong anak ng isang mayamang mag-asawa. Malaki ang pagkakahawig ni Jeric kay Christian.
Makalipas ang 15 taon, sila'y muling magtatagpo, dala ang kani-kanilang bagong pagkatao, at muling iibig sa isa't isa. Ngunit paano kung ang kanilang mga puso ay naipangako na sa iba?

Mula sa orihinal na likha ni Carlo J. Caparas, naging malapit sa puso ng mga Pinoy"bata man o matanda"ang Kamandag dahil sa kuwento nito tungkol sa isang nilalang na naghahanap ng pag-ibig, pamilya, at halaga niya sa buhay matapos matuklasan ang kapangyarihan.
Pinangungunahan ng Primetime King na si Richard Gutierrez na gumaganap bilang si Vergel at Kamandag, ang pinakabagong Pinoy superhero na kalahating tao at kalahating ahas na ginagamit ang kapangyarihan sa kabutihan.
Kasama ni Richard sa engrandeng telefantasyang ito ang ilan sa mga pinagpipitagang artista sa industriya ‘tulad ni Johnny Delgado at ang pinakabagong miyembro ng Kapuso Network na si Eula Valdez.
Ito ang kauna-unahang proyekto ni Eula Valdez sa GMA-7. Ayon kay Eula, masaya siya sa role na ibinagay sa kanya bilang si Reyna Alicia. Naghahanda na rin si Eula sa mga action scenes na kanyang gagawin dahil magkakaroon ng pagbabago sa kanyang karakter na ngayon ay nakakulong sa selda.
Ang award-winning actor naman na si Johnny Delgado na gumaganap bilang si Haring Budog ay patuloy na pinahahanga ang kanyang mga kasamahan at mga manonood sa kanyang galing sa pag-arte dahil kahit walang dialogue, naipapakita niya ang mensaheng gusto niyang iparating.
Kabilang sina Eula at Johnny sa mga karakter mula sa kaharian ng Ambograw na may limang lahi"ang mga Hasbaya (ahas), Buson (lobo), Kibal (musang), Bagol (toro), at Lubot (unggoy).
Kung si Richard ang mabait na si Vergel at superhero na si Kamandag, si Mark Anthony Fernandez naman ang bad boy na si Lucero at super villain. Kapwa sila merong super powers na kahalintulad ng sa ahas, pero ginagamit ito ni Vergel sa kabutihan samantalang pumapatay naman si Lucero.
Tuwang-tuwa si Mark sa tiwalang ibinigay sa kanya ng GMA-7 at hindi naman nagkamali ang management sa pagpili sa kanya dahil sa galing ng aktor ay swak na swak sa kanya ang karakter na si Lucero. Kakaiba rin ang chemistry nila Richard at Mark sa TV bilang best friends na magiging worst enemies.
Mula sa direksyon nila Mark Reyes at Topel Lee, ipinagmamalaki rin ng Kamandag ang world-class production design nito mula sa magarbong costumes na likha nina Noel Flores at Bill Gustilo hanggang sa rainforest set ng kilalang production designer na si Rodel Cruz at ng kanyang team, pati na rin ang makapigil-hiningang action-packed scenes matapos ang matinding training ni Richard ng Jujitsu kay international Ultimate Fighting Championship superstar Brandon Vera. Bukod dito, gumagamit din ang Kamandag ng mga tunay na ahas sa taping para mas maging makatotohanan ang eksena. Ang grupong Larger Than Life naman ang gumagawa ng magagandang visual effects ng show.
Ang Kamandag ang huling pasabog ng GMA-7 sa 2007 na nagsimula noong Nobyembre 19 at nakakuha ng overnight ratings na 42.7 percent sa pilot episode nito. Simula noon, patuloy na mataas ang ratings na nakukuha nito at tinututukan nang husto ng maraming Pinoy.

Earlier today, December 18, Wowowee host Willie Revillame made reference to the TV ratings controversy involving his home network ABS-CBN and AGB Nielsen Media Research Philippines, the data gathering organization responsible for determining TV ratings. The Kapamilya network has recently filed a P63-million civil suit against AGB for "damages and injunction, with an application for a temporary restraining order."
A few hours ago, registered users of the site uploaded videos in the video-sharing site YouTube titled "Kita Nyo?" that show how Willie and his co-hosts Mariel Rodriguez and Valerie Concepcion rehearsed various scenarios involving the same person and the same golden wheel used as a prop in the "Wilyonaryo" segment of the Wowowee.
The registered user named "absmadaya" uploaded a three-minute video while "gaboikent" shared a five-minute video showing the same rehearsal of Wowowee. Willie and his co-hosts are practicing the segment "Wilyonaryo," wherein the contestant is asked to choose a colored wheel. In this video, Willie practices opening and closing the flap that covers the number inside.
A technical staff member of the show puts a gold wheel in the middle and Willie tells him, "Masikip talaga." The male staff member makes adjustments and helps him "operate" the gold wheel. Willie rehearses changing the number inside the gold circle. He opens the flap to reveal a portion of the number that makes it undeniably a number five, but then he closes the flap again and it appears to be the straight edge of a totally different number. But when Willie pulls it off completely, it is again a number five.
In the first scenario, Willie opens the gold wheel revealing a number 5, indicating that the contestant wins P500,000. The co-hosts and the backup dancers all rejoice at the good fortune. As the video continues, they also rehearse the scenario wherein a number zero is revealed using the same gold wheel. The contestant loses, to everyone's dismay.
"Wilyonaryo" is the controversial segment wherein Willie accidentally showed the wrong number in the jackpot portion of the August 20 episode of the noontime show. It also started the word war between Willie and fellow TV host Joey de Leon of rival program Eat Bulaga. The Kapamilya network explained that the mistake was a result of a "technical glitch." By October, Wowowee discontinued the segment and replaced it with the "Merrygalo" segment.
When asked to comment about this rehearsal video, ABS-CBN Corporate Communications Head Bong Osorio told PEP (Philippine Entertainment Portal), "That's an old issue. That has been going on for months, it stopped...We don't know why it's resurfacing. It's an old issue. It has been discussed lengthily in the tabloids, TV, and afternoon programs. It has quietly taken a back seat until this afternoon."
PEP asked him who could be the people behind this video and he answered vaguely, "I can only surmise..." There are talks that the "leakage" of the rehearsal video may have been brought about by the TV ratings war going on. |

A few hours after ABS-CBN publicly announced filing a P63-million civil case against media research group AGB Nielsen Media Research Philippines for failing to conduct an investigation on the alleged cheating in the data gathering of television ratings, Kapamilya network's rival station, GMA-7 issued a statement, saying:
"GMA Network is concerned about the report that the true ratings of the TV programs as reported by AGB can be manipulated. The accuracy of the ratings of the TV programs is of utmost importance not only to the TV stations but also to the advertisers, ad agencies, and the viewing public.
"For more than four years now, GMA Network has been complaining to AGB about the highly illogical and unexplainable disparity between the cable and non-cable ratings of GMA's programs, which do not obtain in respect to ABS-CBN's programs.
"GMA-7 is keenly interested in getting at the bottom of this if there is any basis at all to the said reports."
HIRED TO BRIBE. In a press conference called by ABS-CBN earlier today, the Kapamilya network had said that someone paid a visit to their Bacolod office and confessed that he, along with others, are hired to locate and bribe some households tapped by AGB Nielsen as part of the sample for the survey and data gathering.
Upon discovering that a household is part of the surveyed group, the hired people would offer a P500 bribe or grocery items to the sampled members in exchange for deliberately switching channels to favor a particular network.
In a video shown by ABS-CBN during the press conference, the "source" was not strongly pinning AGB Nielsen as the guilty culprit for the anomaly. Interestingly, a particular "network" was pointed at as the perpetrator of the appalling act. The name of the network though was censored in the final edit of the video and omitted in the statement.
"It is ______ [network] that gives us orders. That's ______ network," said the informant, whose identity was hidden in silhouette.
The informant added, "Of course, we are aware and they [the "network"] are aware that they are losing in Bacolod. That ABS is what most people tune into. That's why they want to get a handle on the meters so that they can watch, wtachamacallit, they can have a share in the ratings and advertising."
ABS-CBN officers insisted that they're focusing their sights on AGB Nielsen after the media research body failed to heed their request for an investigation to probe and verify the confession made by their informant.
"Thus, today [December 14], we have filed a case against AGB Nielsen Media Research Philippines for damages and injunction, with an application for a temporary restraining order," said ABS-CBN Head of Research Vivian Tin.

ABS-CBN network has filed a case against AGB Nielsen Media Research for allegedly failing to comply with their request to conduct an investigation and probe reports of cheating and tampering in the gathering of ratings data for television.
In an emergency press conference called by ABS-CBN earlier today, December 14, at the 9501 restaurant, network officials, led by Head of Corporate Communications Bong Osorio, labeled the matter as a "systematic, organized, and well-funded attempt to cheat in the ratings."
Also present during the press conference were Atty. Maximilian Joseph Uy, Head of Research Vivian Tin, Head of Regional Network Ron Valdueza, and Head of Finance Mike Navarrete.
"Today, we have filed a civil case against AGB Nielsen Media Research Philippines for damages and injunction, with an application for a temporary restraining order," read an official statement of ABS-CBN.
DETERMINING VIEWING HABITS. Identifying program ratings is essential because it represents the "viewing behavior" of the public. For the networks, it is one way to have a clear grasp on the preference of their viewers when it comes to programs being offered in specific timeslots.
The end result of these studies is crucial for business since advertisers base their ad placements on the data produced.
In an interview with AGB Nielsen's General Manager, Maya Reforma, a few months ago, she stressed the importance of ratings to the networks and their clients.
"It is the means by which airtime is being traded between the advertisers and the networks," explained Maya to PEP (Philippine Entertainment Portal) in an interview conducted at the AGB Nielsen office in Libis, Quezon City.
"Of course, networks sell airtime and to attach a value to that airtime, it is based on how many people are actually watching. So therefore, the establishment of a rating system is critical to that transaction."
AGB Nielsen Media Research is an international data gathering organization responsible for determining TV ratings. The company operates in 27 countries and is recognized worldwide as an independent organization using a "reliable, independent, and transparent audience measurement system."
An independent and distinguished survey body is necessary to assure that the figures and result are uniform.
"It has to be a common one because they have to be using the same reference. Hindi puwedeng sa numbers namin hindi ka number one, 'tapos the other one says their number one," explained Maya.
GENERATING DATA. TV ratings are being conducted by setting up first a panel of homes that are randomly sampled to represent the viewing behavior of homes in the areas that are covered by the study.
It is of course impossible to tap all the households in a particular area, given the enormous number"which explains why random selection is carried out. This is the usual practice in conducting widescale survey and research.
After determining the selected homes within the panel, meters are attached to all TV sets in each household. Along with the meter is a handset where names of all members of the household are written. Beside each name is a button that, once pushed by the viewer, automatically transmits to the meter which program and channel is being watched at a specific time.
Through the metering device and the handsets, the television ratings service will be able to report what channels different homes are watching and the types of people watching different channels and programs.
MONEY FOR RATINGS. According to Vivian Tin, ABS-CBN was alarmed when a man suddenly appeared in their Bacolod office to divulge an anomaly in the ratings system being administered by AGB Nielsen.
According to the alleged source, the panel of homes in Bacolod"which serves as the sample tapped by the research agency in generating the data around the area"have been infiltrated by an outside party.
"In the TV ratings research business, the identities of panel homes are closely guarded so that no outside party can approach to induce them to watch channels or programs that they would not normally watch," read Vivien from a prepared statement.
In research data gathering, it is vital that the names, homes, and identification of the selected group being studied remain anonymous and independent from outside interference so as not to influence their actions.
"Being a representative requires that the panel has been properly and statistically sampled," explained Vivien to the press. "Additionally, the panel members must be reflecting their normal behavior... They are watching what they want to watch and when they want to watch it."
A video clip was played during the press conference. The informant narrated in Ilonggo how his group was being paid by a specific organization to scout, then identify, the sample households and bribe the members to deliberately switch channels in favor of the requesting party.
"We moved around barangays," revealed the informant whose face was never shown in the video. "We asked each household where the device is. When we find out that the house has one, we go there."
As revealed, AGB Nielsen gives grocery items "or other things they can use in the household" as goodwill to the survey participants. This is totally legal.
A counter-offer is then offered by the "outside party" to sway the sampled household. "We approach the house and make a counter-offer of P500 cash or groceries. If they accept our offer, which almost always happens because of poverty, they will accept and we convince them to shift the channel to the other station," said the "scared" informant.
Curiously, a network is being dragged as the perpetrator of the illegal act. The exact name of the network was omitted, however, every time it was being mentioned by the source.
"It is ____ [network] that gives us orders," confessed the informant, "... there's seven of us involved and we go around the barangays and we simply look for the AGB meters."
The "network," added the source, was losing in the ratings game in Bacolod, thus explaining the alleged dirty tactic.
"That's why they want to get a handle on the meters so that they can have a share in the ratings and advertising."
When asked if AGB Nielsen had any idea of the unlawful practice, the informant boomingly said, "No""indicating that the act is solely carried out by a specific "network" and not by the research group.
LEGAL ACTION. ABS-CBN representatives stressed that the civil case against AGB Nielsen was brought about by the media research firm's refusal to heed their call for an investigation.
The Kapamilya network said that they provided all the information they had gathered to AGB Nielsen. ABS-CBN added that "even as we continue to lead nationwide" this didn't hinder them from making a request to the survey agency to "check their panels" and guarantee first the integrity of their data.
"Given the importance of the service and the impact it has to the decisions of networks and advertisers, we have demanded that AGB-Nielsen Media Research Philippines shut down their service and investigate the degree to which their panel has been breached. We asked that they resume their service only after they can fully assure their clients that the panel has been completely cleaned," said Vivian about their formal letter to AGB Nielsen.
A video of ABS-CBN Chairman and CEO, Mr. Eugenio "Gabby" Lopez III, was also shown. He announced, "Today, we have filed a civil case against AGB-Nielsen Media Research Philippines for damages and injunction, with an application for a temporary restraining order."

Due to a technical problem, AGB Nielsen Philippines failed to release an overnight rating last Tuesday, December 11. But noticeably absent in the Top 10 primetime shows from December 12 to 13, Wednesday and Thursday, was Book 2 of ABS-CBN's major drama series Maging Sino Ka Man.
After posting a rating of 23 percent on its pilot episode, Maging Sino Ka Man dramatically dropped to 18.9 percent Wednesday and 18.7 percent last night. The Kapamilya soap opera is pitted against GMA-7's Marimar, which continues to dominate the primetime slot. The Marian Rivera-starrer got an identical 44.3 percent rating Wednesday and Thursday, holding on to its throne at No. 1.
Richard Gutierrez's Kamandag was steady at No. 2 by virtue of its 37.9 percent rating last Wednesday and 37.4 percent last night.
Zaido was No. 3 on Wednesday with 34.4 percent, but it dropped to 4th place the following night after being bumped off by 24 Oras and La Vendetta, which both got 32.9 percent rating. GMA-7's primetime newscast was No. 4 last Wednesday with 33.3 percent while the horror-drama series was No. 5 with 31.2 percent.
Vhong Navarro's fantaserye Lastikman was the top show among ABS-CBN primetime programs. It was No. 6 last Wednesday with 23.7 percent and stepped up to No. 5 the following night with 24.4 percent.
Princess Sarah is the second most-watched Kapamilya show with 22.3 percent rating Wednesday and 23.5 percent Thursday.
Pinoy Big Brother Celebrity Edition 2 and Hwang Jini were also steady at No. 8 and No. 9, respectively, while TV Patrol World and Ysabella alternately held the 10th spot.
In the daytime race, Eat Bulaga! is still the leading noontime program, with Whammy!, Daisy Siete, Pasan Ko Ang Daigdig, and Deal or No Deal consistent in their positions from No. 2 to No. 5.
The rest of the Top 10 are occupied by Wowowee, Game KNB?, My Only Love, Couple or Trouble, and Takeshi's Castle.
In connection with the TV ratings, ABS-CBN sued AGB Nielsen Philippines earlier today, December 14, "for continuing to release nationwide TV ratings despite information that metered households used to gauge nationwide TV ratings might have been tampered."

It's a big opening salvo for ABS-CBN and Filipinos worldwide as the Kapamilya Network opens the year with a blast via the upcoming action drama fantaserye based on an original script of Ricky Lee.
From Star Television, Lobo is expected to be an exceptional project because it will be produced by the same creative group working under the drama anthology Maalaala Mo Kaya, and brought high caliber teleseryes like Maging Sino Ka Man, Ysabella, Flordeluna, Sa Sandaling Kailangan Mo Ako, Pangako Sa'Yo and other popular soap operas to the TV screen.
In fact, Piolo has been practicing firing a gun in a shooting range in preparation for his role as a Philippine Military Academy (PMA) graduate. "It feels good that the network continues to trust me with such noteworthy projects. Thank you Tita Malou [Santos, Star Cinema head] Direk Olive [Lamasan] for giving me Lobo and for giving me an opportunity to work with Angel. I've known her as a co-worker and as an actress. But I'm happy that I gained a friend in her while working on this project," Piolo points out.
As for Angel, she has been taking up different classes to hone her skills. "We enrolled in different workshops. May modeling, paragliding at marami pang ibang magaganap, pero hindi ko muna sasabihin para surprise talaga!" exclaims Angel. "It feels good that ABS-CBN is really taking time and effort to prepare for this project because I think we are all one in believing that we have to give our audience only the best. That's why I'll always be grateful to ABS-CBN for this dramatic vehicle."
With barely two months before the teleserye entertains us, the production promises that this is essentially a love story above everything else. FM Reyes (Maging Sino Ka Man) and Cathy Garcia-Molina (You Got Me, You Are the One, One More Chance) will be helming Lobo, which Angel and Piolo promised to give their all.

She made the whole province of Lucena proud when she bested eleven talented singers and emerged as the winner of Philippine Idol, the local franchise of the worldwide hit series American Idol. The reality singing competition was produced by and aired in ABC-5 last year.
Now, Mau Marcelo will try to surpass her achievement and make the whole Philippines proud as she represents the country in the very first Asian Idol competition.
Asian Idol will be held in Jakarta, Indonesia on December 15, Saturday (for the performance show which will start at 8:30 p.m.) and December 16, Sunday (results show, 10 p.m.). The show will be aired live via satellite on ABC-5 on the said dates.
Mau will compete against the winners from five other Asian countries with an Idol franchise. These are Indian Idol Abhijeet Sawant, Indonesian Idol Mike Mohede, Malaysian Idol Jaclyn Victor, Singapore Idol Hady Mirza and Vietnam Idol Phuong Vy. The winner will get an international recording contract and an all-expense paid trip (with pocket money) around the world to watch other international Idol shows.
A special primer titled Road to Asian Idol will air this Saturday, December 8, at 8 p.m. (before the Shall We Dance two-part special) on ABC-5. This episode traces the journey of the contestants"from their auditions to their preparations for the Asian Idol arena.
"Everybody should watch Road to Asian Idol because the show will also include information on how the viewers can vote for their favorite Idol finalist," says Mau.
The 27-year old singer has been preparing exhaustively for the contest. She knows for a fact that her triumph would not be just for herself but for the whole country as well. Aside from following a strict diet, she undergoes rigorous training including personality development under stage director Freddie Santos and voice training under singer Zebedee Zuñiga.
According to Mau, each contestant is required to sing one English song and a song in their native language. Mau had submitted eight song titles for the Asian Idol organizers to choose from and they have selected Dulce's "Ako Ang Nagwagi" and Gloria Estefan's "Reach" as her songs for the competition.
"I'm so excited and nervous at the same time. This is such a big deal for me since I'm not just representing myself but our country as well. I hope the Filipinos will help me win again by voting for me, this time, as the first Asian Idol," appeals the Soul Singer.
Aside from Mau, Asia's Queen of Song and Philippine Idol judge Pilita Corrales will also be in Jakarta as one of the judges in Asian Idol along with other Idol judges Paul Moss (Malaysian Idol), Indra Lesmana (Indonesian Idol), Ken Lim (Singapore Idol), Anu Malik (Indian Idol) and Siu Black (Vietnam Idol).

The Makati standoff led by Senator Antonio Trillanes last Thursday, November 29, held the daytime programming hostage. Coverage of the highly tense situation"from late morning to late in the afternoon"dominated the top two spots in the ratings game with GMA-7's Breaking News leading the way with 27.2 percent, while ABS-CBN News Patrol followed closely with 26.8 percent.
Because of this development, Eat Bulaga! was relegated to the third place with 25.3 percent. Willie Revillame's Wowowee came in at fourth with 22.1 percent.
Notably, two morning talk shows"SiS and Boy & Kris"benefitted from the Manila Peninsula scuffle. The show of Janice de Belen, Carmina Villarroel, and Gelli de Belen registered a 14.1 percent grade. Boy Abunda and Kris Aquino's morning show also held their own, gathering a 13.4 percent rating to barge inside the winning column.
The rest of the afternoon programs had to be scrapped to give way to the Manila Pen standoff.
The coverage of the Manila Pen siege continued until the primetime newscast with 24 Oras posting a 35.6 percent rating compared to News Patrol's 30.1 percent.
Not much has changed in the primetime competition, although La Vendetta's slide to the No.9 position was highly noticeable. Pangarap na Bituin (26 percent), Princess Sarah (25.5 percent), and Pinoy Big Brother Celebrity Edition 2 all ganged up on the suspense-drama series to own the sixth to eights spots, respectively.
Everything returned to normal the following day, November 30, and Eat Bulaga! reclaimed the throne. Registering a 21.2 percent rating, the country's longest-running noontime show dealt Whammy! Push Your Luck a telling blow. Settling for No. 2, Rufa Mae Quinto and Paolo Bediones's game show amassed a rating of 19.1 percent.
Saturday, December 1, was Vic Sotto Day. Kapuso Sine featuring the third installment of Enteng Kabisote reigned in the daytime race as proven by its 27.5 percent showing. Eat Bulaga! which is being co-hosted by Vic, settled at No. 2 with its 23.6 percent rating.
ABS-CBN"s Cinema FPJ (16.9 percent) claimed the third spot while Wowowee and Super Inggo 1.5, bearing a similar 16.7 percent rating, hung on to fourth place.
Bitoy's Funniest Video's remained spotless in the primetime category. Bolstered by its 33.7 percent rating, Michael V has once again proven that he owns Saturday evenings.
December 2, Sunday, saw ABS-CBN scoring a knockout, thanks to the strong showing of the Donaire versus Maldonado boxing bout. The match, dubbed as Affirmation, collected a 17.7 percent grade, which was more than enough for a triumph over the other daytime programs.
Not to be outdone, Kay Susan Tayo showed enough grit to challenge the boxing event. With a 14 percent rating, Susan Enriquez's infotainment show grabbed the No. 2 spot and even upstaged ASAP 07's 12.6 rating.
Showbiz Central trounced close rival The Buzz with a manageable margin. For the week, Kapuso network's showbiz talk show tallied 12.3 percent rating as compared to its competitor's 11.6 percent.
Primetime Sunday was again on a standstill with Tok! Tok! Tok! leading the way anew with a 25. 1 percent rating.

Book 2 of the much-awaited ABS-CBN soap opera Maging Sino Ka Man opened last night, December 10, without much fanfare. The powerhouse drama series posted a rating of 23 percent, which is good for only 9th overall. But it is expected to peak once the viewers identify themselves again with the old and new characters of Maging Sino Ka Man.
While GMA-7 shows occupied the top half of the Top 10 slots"with Marimar at No. 1 with 40.7 percent"ABS-CBN programs grabbed the bottom half, with Ysabella (20.7 percent) squeezing back to the winning column at No. 10, pushing Hwang Jini (20.1) and Pinoy Big Brother Celebriy Edition (20 percent) outside the Top 10.
Meanwhile, ABS-CBN's other primetime soap, Pangarap na Bituin, almost reached the 30-percent mark on its final episode last Friday, December 8. The said soap posted a rating of 29.6 percent to snatch the 5th spot from GMA-7's primetime newscast, 24 Oras, which rated 27.1 percent.
Marimar was sill the leader though with 45.5 percent as La Vendetta edged out Zaido for the No. 3 spot. La Vendetta got 32.1 percent rating while Zaido managed to get 31.9 percent.
Conspicuously absent in the Top 10 is Pinoy Big Brother Celebrity Edition, which tied at the 11th place with Ysabella with identical 20.3 percent rating. Hwang Jini, in the meantime, made a comeback in the winning column by placing 9th overall with its 23.5 percent rating.
In the daytime race, Eat Bulaga! was the top show with 21.1 percent rating; followed by Daisy Siete with 19.3 percent.
The following day, December 8, Eat Bulaga! once again topped the daytime race by virtue of its 22.2 percent rating while Super Inggo 1.5 was at No. 2 with 20.1 percent.
Manny Pacquiao's new show in GMA-7, Pinoy Records, finished at third spot with 19 percent.
Bitoy's Funniest Videos, meanwhile, was the leader among the primetime shows with 31.3 percent rating. It was followed by Kapuso Mo, Jessica Soho (26.9 percent), Kakasa Ka Ba Sa Grade 5? (25.6 percent), 1 vs. 100 (24.4 percent), and Pinoy Big Brother Celebrity Edition (24.2 percent) to complete the Top 5.
The boxing match between undefeated fighters Floyd Mayweather and Ricky Hatton was the most-watched daytime show last Sunday, December 8. The televised fight, which was won by Mayweather, posted an 18.5 percent rating.
Surprisingly, GMA-7's infotainment program Kay Susan Tayo placed second with 16.3 percent.
SOP took advantage of the delayed telecast of its rival, ASAP '07, to win the battle of Sunday musical variety shows. SOP got 14.6 percent to grab the third spot while ASAP '07 had 11.9 percent, which is good for No. 6.
For six straight weeks, Showbiz Central won over its competitor, The Buzz. Kapuso's showbiz talk show posted 14 percent rating against the The Buzz's 11 percent.
Finally, Kap's Amazing Stories topped the primetime shows with 30 percent rating; closely followed by Tok! Tok! Tok Isang Milyon Pasok with 29.4 percent.
The third death anniversary special of Fernando Poe, Jr. on ABS-CBN, titled Alay ni Da King, was at No. 4 with 20.4 percent, just behind Mel & Joey's 23.2 percent.
Just missing the Top 10 were Vic Sotto's sitcom Ful Haus at No. 11 with 11.9 percent and the reality show Pinoy Big Brother Celebrity Edition at No. 12 with 10.1 percent.

Kapag nagkataon, dalawang malaking "lipatan" ang magaganap sa susunod na taon kung saan dalawang artista-search winners ng ABS-CBN at GMA-7 ang balitang mag-o-ober da bakod"sina Hero Angeles at Jennylyn Mercado. Si Hero ang kauna-unahang winner ng Star Circle Quest ng ABS-CBN samantalang si Jennylyn naman ang first Ultimate Female Survivor sa StarStruck ng GMA-7. Malakas ang bulung-bulungan na pipirma na raw sa GMA Artist Center si Hero, samantalang si Jennylyn naman ay malaki ang posibilidad na lumipat na sa ABS-CBN pagkatapos ng kontrata niya sa Artist Center sa February 2008. Mula sa isang tao na konektado sa GMA-7, napag-alaman ng PEP (Philippine Entertainment Portal) na nakahanda na raw ang pagpirma ni Hero bilang Kapuso talent. Ang nag-aasikaso raw ng napipintong pagpirma ng young actor sa GMA-7 ay walang iba kundi si German "Kuya Germs" Moreno na tumatayong consultant ngayon ni Hero.
Samantala, hindi rin mamatay-matay ang isyu na lilipat na sa ABS-CBN si Jennylyn. Mula pa rin sa isang reliable source, sigurado na raw ang paglipat
Lalo pang umigting ang balita na lilipat na nga si Jennylyn sa ABS-CBN nang magbitiw siya ng salita sa panayam niya sa PEP na hindi niya isinasara ang kanyang pintuan sa Kapamilya network. Aniya, "Hanggang next year pa ang contract ko sa GMA Artist Center. Pag-uusapan pa rin po naman namin ‘yon ng manager ko at ng GMA. Pero hindi ko po isinasara ang pintuan na puwede akong lumipat sa ABS-CBN." Ang pahayag na ito ni Jennylyn ay taliwas sa sinabi niya noon na hindi na siya magre-renew ng kontrata sa manager niya na si Becky Aguila kapag nag-expire na ito next year. Ilang beses din niyang sinabi na "loyal" siya sa GMA-7 dahil dito siya nakilala at sumikat. Matatandaang nagkalamat ang relasyon ni Becky at ng GMA-7 management nang inilipat ng talent manager ang dating prized talent ng Kapuso network na si Angel Locsin sa ABS-CBN. Dahil dito ay nadamay ang iba pang mga alaga ni Becky na nasa GMA-7, partikular na si Jennylyn. Sa ngayon, bukod kay Angel, halos lahat ng mga alaga ni Becky na dating nasa GMA-7 ay nasa ABS-CBN na gaya nina Valerie Concepcion at Charming Lagusad. While Marimar and four other primetime Kapuso programs are comfortably safe in their positions as the Top 5 primetime shows, the slots for the rest of the Top 10 are occupied by Kapamilya shows but with some movements.
Marimar is still the undisputed queen of primetime shows as it topped the overnight ratings from December 3 to 6, while the second to fifth slots were occupied by Kamandag, Zaido, 24 Oras, and La Vendetta, repectively.
The highest rating Marimar posted this week was 45. 4 percent last Tuesday, December 4, and its lowest was on Wednesday, December 5, with 41.7 percent. The Marian Rivera-starrer's rating has never dropped below 40 percent since November 2.
The ABS-CBN soap opera Pangarap Na Bituin is showing strength on its final week. After finishing seventh overall behind TV Patrol World last Monday, December 3, the musical-themed show moved to No. 6 from Tuesday until Thursday (Dec. 4 to 6). Its final episode tonight is expected to top the 28.5 percent rating it posted last night.
Starting Monday, December 10, Pangarap Na Bituin will be replaced by the much-awaited Book 2 of Maging Sino Ka Man featuring a powerhouse cast led by John Lloyd Cruz, Bea Alonzo, Anne Curtis, and Sam Milby.
Meanwhile, three shows occupied the No. 1 slot in the daytime race this week.
Kapamilya, Deal Or No Deal (20.1 percent) topped the race last Monday, Whammy! Push Your Luck (19.8 percent) last Tuesday, and Eat Bulaga! stole the top spot last Wednesday and yesterday by virtue of its 21 percent and 22.6 percent ratings.
The rest of the Top 10 was occupied by the same shows, except Thursday when SiS (No. 9, tied with Couple Or Trouble) and Prinsesa Ng Banyera (No. 10) moved into the winning circle because of a tie in second place (Daisy Siete and Deal Or No Deal) and in ninth place.
